Ketua Komisi X DPR RI, Teuku Riefky Harsya menyatakan bila tunjangan guru dipotong, pemerintah melanggar UUD 45 dan sejumlah UU yang berkaitan dengan pendidikan.
"Yang perlu dicermati pemerintah untuk tidak melanggar UUD 45 pasal 31 ayat (4), Pasal 49 ayat (1) UU No. 20 Tahun 2003 tentang Sistem Pendidikan Nasional, Pasal 82 UU No. 14 Tahun 2005 tentang Guru dan Dosen, Pasal 20 UU No. 12 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 14 Tahun 2015 tentang Anggaran dan Pendapatan Belanja Negara Tahun Anggaran 2016," kata Teuku Riefky Harsya di Jakarta, Senin (29/08/2016).
20% Anggaran pendidikan dari total Anggaran 2.072,9 trilliun pada APBN P 2016 adalah sebesar Rp416,6 triliun. Jika anggaran TPG dipotong sebesar Rp23,4 triliun, sambung dia, maka anggaran belanja negara akan menjadi Rp2.059,5 triliun dan anggaran pendidikan akan menjadi Rp393,2 triliun atau masih di bawah 20% dari total anggaran belanja negara.
"Ini artinya ada potensi anggaran pendidikan tidak memenuhi amanat konstitusi dan ketentuan peraturan perundang-undangan," kata politisi Partai Demokrat ini.
Ia menambahkan, data yang dikemukakan oleh Kemenkeu untuk memotong tunjangan guru sebesar Rp23,4 triliun dalam APBN P 2016 perlu diklarifikasi, mengingat antara jumlah guru dengan anggaran yang akan ditunda tidak rasional.
Bahkan, kata dia, data yang dikemukan oleh Menkeu, Sri Mulyani berbeda dengan data dari Kemendikbud. "Data yang dikemukakan terjadi lebih hitung 78.811 guru tetapi anggaran TPG yang ditunda sebesar Rp23,4 triliun. Artinya alokasi anggaran per guru Rp296,9 juta/tahun atau Rp24,7 juta/bulan," terang Riefky.
Kemudian, sambung Riefky, data guru yang bersertifikat yang dikemukakan Menkeu, Sri Mulyani sebanyak 1.300.758 orang (sebelum dikoreksi menjadi 1.221.947 orang), sementara data total guru menurut Kemendikbud yang disampaikan pada saat Raker dengan Komisi X pada tanggal 16 Juni 2016 menunjukkan bahwa guru yang diangkat sampai dengan tahun 2015 sebanyak 1.755.010 orang (tersertifikasi 1.638.240 orang).
"Ada perbedaan sejumlah 337.482 guru, suatu jumlah yang sangat signifikan," jelasnya.
Bila disandingkan dengan data pokok pendidikan dasar dan menengah per 27 Agustus 2016 akan berbeda lagi. Rekap Nasional Semester 2016/2017 ganjil, total guru ada sejumlah 1.648.237 orang (http://dapo.dikdasmen.kemendikbud.go.id/).
"Sampai di sini ada tiga data yang berbeda. Pertama 1.300.758 guru, kedua 1.638.240 guru, dan yang terakhir 1.648.237 guru. Yang mana data yang benar?" tanya politisi Partai Demokrat itu.
Lebih lanjut, anggota DPR RI asal Aceh itu menyebutkan, pada saat pembahasan RAPBN tahun anggaran 2016 Dirjen Guru dan Tenaga Kependidikan Kemendikbud menyampaikan bahwa TPG naik tahun 2016. Kenaikan ini berdasarkan data, pada tahun 2016 akan ada 166 ribu guru yang disertifikasi. Artinya sampai dengan tahun 2016 akan ada 1,8 juta guru yang tersertifikasi.
"Dengan data ini, ada perbedaan 600 ribu guru yang tersertifikasi antara data Kemendikbud dengan Kemenkeu," pungkasnya.[Sumber : rimanews.com]
