Bukannya menikmati sisa umur di masa tuanya dengan tenang, seorang kakek bernama H Muhamad Bola, warga Desa Ranggasolo, Kecamatan Wera, Kabupaten Bima, Nusa Tenggara Barat (NTB), malah dilaporkan oleh anak dan menantunya di Pengadilan Negeri (PN) Raba Bima.
Kakek berusia 74 tahun itu digugat oleh anak pertamanya, Hj Jahari dan suaminya, H Arsad, sebesar Rp 216 juta atas kasus sengketa lahan.
Selain digugat secara materi, Muhamad juga digugat untuk hengkang dari lahan yang kini dijadikan tempat tinggal bersama anak bungsu dan menantunya di rumah panggung 9 tiang.
“Orangtua saya digugat karena dituduh melakukan perbuatan melawan hukum atas kasus sengketa lahan. Pengugatnya adalah H Arsad, menantu H Muhamad. Sementara Hj Jahari adalah kakak saya sendiri, anak pertama H Muhamad,” tutur Yusran, anak bungsu Muhamad, yang juga menjadi pihak tergugat saat ditemui di PN Raba Bima, Rabu (7/6/2017).
Yusran menyebutkan, awalnya, sebidang tanah sengketa ini merupakan lahan penggarapan.
Tanah seluas 1.564 meter persegi yang semulanya lahan kosong itu telah dikuasai oleh orangtuanya selama berpuluh-puluh tahun.
Namun dalam beberapa tahun terakhir, lanjut dia, sang kakak secara diam-diam ingin menguasai tanah tersebut. Bahkan telah membangun gudang penggilingan padi.
“Awalnya, dia (penggugat) minta tempat untuk membangun gudang penggilingan. Setelah diberikan tempat usaha oleh orangtua saya, baru dia mau menguasai semua. Padahal tanah itu sudah puluhan tahun ditempati orangtua saya,” tutur Yusran.
Sebelum dilaporkan, lanjut Yusran, tergugat telah membagikan tanah yang belum bersertifikat ini kepada empat anaknya saat pengukuran Prona tahun 2016 lalu. Saat dibagikan juga disaksikan oleh Arsad sebagai penggugat.
“Bahkan luas tanah itu lebih besar Hj Jahri ketimbang adik-adiknya. Suaminya (Arsad) tidak keberatan saat tanah itu dibagikan,” kata Yusran.
Namun belakangan, penggugat meminta tambahan jatah. Bahkan ditengarai ingin mengusasi semua lahan yang ditempati orangtuanya.
“Sampai-sampai dia (Hj Jahari) mendorong suaminya untuk mengajukan gugatan ke Pengadilan. Dalam gugatanya, kurang lebih 3.000 meter persegi. Kalau di kita, menurut SPPT dan DHKP, hanya 1564 meter persegi,” tutur Yusran.
“Selain tanah, penggugat juga menggugat materi berupa uang sebesar Rp 216 juta sebagai ganti rugi usaha penggilingannya yang ditutup oleh tergugat selama sengketa,” tambahnya.
Menurut dia, pihak keluarga sudah kerap kali melakukan mediasi sebagai upaya damai. Namun, penggugat tetap ngotot melanjutkan perkara ini sampai ke meja hijau.
“Upaya damai sudah sering kami lakukan, baik di tingkat desa maupun di kantor camat. Tetapi, mereka bersikeras melaporkan masalah ini ke pengadilan,” ujar Yusran.
Sebagai seorang anak, Yusran merasa simpati terhadap orangtua kandungnya akibat ulah anak dan menantu yang kompak menggugat sang ayah. Bahkan dia menyatakan siap membantu mendampingi ayahnya dalam persidangan berikutnya.
Dia juga optimis orangtuanya bisa memenangkan perkara meski hanya berbekal barang bukti berupa surat pemberitahuan pajak terhutang (SPPT) dan daftar himpunan ketetapan pajak (DHKP).
“Kami punya bukti surat SPPT dan DHKP, sementara pengugat enggak ada bukti sama sekali. Dia hanya mengandalkan surat palsu yang terbit tanggal 20 Oktober 2016,” ungkapnya.

Sementara itu, kuasa hukum Arsad, Arifudin, mengatakan, kliennya melaporkan tergugat karena melakukan perbuatan melawan hukum. Menurut dia, tanah seluas 3.000 meter persegi yang terletak di Dore Pajakai, watasan Desa Tawali, Kecamatan Wera, Kabupaten Bima, yang dikalim milik penggugat kini telah dikuasi oleh tergugat.
“Yang kami tuntut adalah pengembalian obyek yang menjadi sengketa,” kata Arifudin saat dihubungi melalui ponsel, Rabu malam.
Menurut kliennya, lanjut Arifudin, pada tahun 1979, obyek sengketa merupakan tanah kosong milik negara. Bupati pada saat itu memerintahkan kepala desa setempat agar tanah-tanah kosong milik negara dibagikan kepada masyarakat.
“Penggugat sendiri mengajukan permohonan untuk mendapatkan bagian atas tanah negara tersebut. Atas permohonan penggugat, kepala desa saat itu menyerahkan tanah seluas 3.000 meter persegi. Setahun kemudian, penggugat melakukan pemagaran dan penanaman pohon di atas lahan-lahan yang diperolehnya,” tuturnya.
Sekitar tahun 1984, lanjut Arifudin, penggugat kemudian membuka usaha penggilingan padi di atas tanah obyek sengketa. Namun seiring waktu, penggugat juga berupaya mengajukan permohonan pengukuran untuk penerbitan sertifikat hak milik. Meski saat ini baru pengukurannya saja yang ditelah dilakukan oleh petugas BPN Kabupaten Bima.
“Setelah penggugat membangun usaha penggilingan dan beroperasi, tergugat kemudian mendatangi penggugat meminta izin untuk menempati sebagian tanah untuk ditanami ubi jalar. Sebagai menantu dari tergugat, penggugat pun mengijinkan saat itu,” tutur dia.
Namun beberapa tahun kemudian, lanjut Arifudin, secara diam-diam tergugat justru ingin menguasai tanah obyek sengketa.
“Tergugat melakukan pemagaran. Tergugat juga membangun rumah panggung enam tiang untuk tempat tinggal di atas lahan sengketa,” ujarnya.
“Tergugat bahkan telah melegalkan status penguasaan tanah dengan cara mendaftarkan SPPT atas nama tergugat. Kemudian tergugat menutup paksa operasional penggilingan padi milik penggugat hingga menyebabkan terhentinya operasi penggilingan,” tambahnya.
Atas tindakan tergugat, lanjut dia, kliennya telah dirugikan baik secara imateriil maupun materiil.
“Maka wajar penggugat menuntut ganti rugi. Tergugat mengganggu operasional penggugat dengan menyegel usaha penggilingan. Penggilingan tidak bisa beroperasi lagi sehingga penggugat mengalami kerugian,” ucapnya.
Dia juga mengatakan, sebelum perkara ini dilaporkan, kliennya telah mengajukan upaya damai dengan menempuh cara kekeluargaan. Namun tidak mendapat respons dari tergugat.
“Tergugat malah ngotot ingin menguasai tanah itu, bukan penggugat. Justru sebaliknya, penggugat mengajukan gugatan karena tergugat tidak memiliki itikad baik. Di persidangan saja pihak tergugat sangat ngotot,” tuturnya.
Dia mengaku, gugatan ini diajukan kliennya berdasarkan alat bukti yang kuat. Oleh karena itu, dia yakin gugatan kliennya akan dikabulkan.
“Terkait bukti-bukti apa yang menjadi alasan penggugat, nanti kami ajukan lewat proses yang berjalan. Yang pasti tanah itu milik penggugat yang didapat dari pemerintah desa,” pungkasnya.
