Yang memprihatinkan banyak orang Indonesia yang tidak menyadari bahwa data pribadi mereka bocor, dicuri, bahkan diperjualbelikan secara bebas oleh oknum-oknum tertentu.
Dua paragraf diatas adalah kutipan dari narasi yang dibacakan penyiar metro TV, Putra Nababan dalam acara 3 60 edisi 11 april 2013.
Data pribadi telah bocor, indikasinya adalah sering menerima telepon atau sms tidak dikenal dengan maksud penipuan. Modus operandinya dengan mengiming-imingi hadiah dan lain sebagainya kepada si korban.
Sekarang ini penipuan melalui sms atau telepon sudah semakin canggih dan menguasai data sang korban. Sang penipu tahu persis nama-nama anggota keluarga sang korban, alamat dan nomor teleponnya
Seorang nenek, Sa’adah (75) tahun bercerita perihal peristiwa yang menimpanya. Telepon berdering di rumahnya, mengabarkan bahwa anaknya sakit keras dan sekarang ada di rumah sakit. “Bu Kholil sakit jatuh pingsan di kamar mandi kantor”, demikian suara pria dari seberang telepon. Kholil adalah anak ke 5 dari 9 putra-putrinya, karyawan swasta di bilangan Jakarta Utara. Spontan sang nenek panik dan segera bertanya: ” Ah yang bener, ada di mana sekarang?”. “Di rumah sakit bu, gawat mau di operasi, kalau ga segera, bisa ga ketolong ni” jawab orang misterius di balik telepon.
Setelah telepon di tutup, nenek Sa’adah menelepon kholil, anak-anak dan mantunya yang lain. Anehnya, setiap kali ditelepon, yang tentunya berbeda nomor teleponnya, orang yang menjawab telepon, orang yang sama, orang misterius tersebut. Ujung ujungnya orang tersebut meminta uang 22 juta rupiah untuk biaya rumah sakit, segera dengan cara ditransfer.
Maka iapun minta bantuan tetangganya, atas hal ini , dan menyarankan menawarkan untuk langsung saja uangnya diberikan tunai. “Langsung aje ni uang tunai ude disiapin, ketemu dimana?”. Kata sang nenek . Telepon langsung ditutup, dan tidak bisa dihubungi lagi. Setelah itu Sa’adah menelepon anaknya, Kholil, dan ternyata dia sehat walafiat ada di kantornya di kawasan Ancol.
Itu satu contoh saja penipuan yang terjadi di masyarakat, ini belum sampai terjadi transaksinya. Banyak sekali yang sudah terjadi transaksi penipuan itu lantaran penipu mengetahui persis data-data pribadi korban dan keluarganya. Siapa namanya, pekerjannya, alamatnya dan seterusnya.
Lantas dari mana pelaku-pelaku kejahatan itu mendapatkan data pribadi korbannya?
Tidak ada yang bisa menjawab pasti, namun ada bebrapa kemungkinan dan pertanyaan. Apakah dari provider telepon, apakah dari warung penjual pulsa? STNK?, SIM?, facebook?, twitter?, BBM? ataukah dari e KTP?
Undang-undang tentang perlindungan data pribadi sudah diberlakukan di berbagai negara, di Asia antara lain Hongkong, Korea Selatan, Malaysia, Singapura, Thailand, dan Philipina. Bagaimana dengan Indonesia?
Shinta Dewi, dosen Fakultas Hukum Universitas Pajajaran, Bandung mengatakan kepada metro TV bahwa : “Di Indonesia belum ada undang-undang mengenai kerahasiaan data-data pribadi, resikonya data-data pribadi masyarakat bisa dikoleksi dan diakses”.
Ironisnya tak sedikit pihak yang memanfaatkan data pribadi masyarakat untuk kepentingan usaha hingga kepentingan politik.
Sewaktu orang membuat e KTP paling tidak ada empat data pribadi yang diambil, foto, tanda tangan, sidik 10 jari, dan merekam retina mata. “Itukan data-data yang sangat pribadi yang harus ada jaminan kerahasiaan datanya tersebut”, kata Shinta Dewi.
Pengalaman arrahmah.com dalam membuat e KTP, September 2012 lalu, sempat bertanya kepada petugas yang mengambil data. Petugas tersebut hanya pekerja swasta alih daya, dia tidak mengetahui data ini nanti diolah oleh siapa, dan kapan jadinya e KTP tersebut. “Saya hanya karyawan kontrak pak, tugasnya cuma ngambil data aja” katanya.
Dan akhirnya Shinta Dewi mewaspadai bahayanya hal ini bila tidak dilindungi UU, “Rawan dan bisa diperjual belikan dengan pihak swasta” katanya mengkhawatirkan.
Bukan hanya soal e KTP hanya boleh di fotokopi sekali, yang dua hari belakangan ini mewarnai pemberitaan, terlambat memberi tahu ke masyarakat, dan itu dampaknya hanya pada fisik KTP tersebut. Lebih jauh dari itu, siapa yang bisa menjamin kerahasiaan data pribadi sekitar 160 juta rakyat Indonesia yang ber e KTP , hingga pada akhir tahun 2013 ini, tidak bocor ke pihak-pihak swasta bahkan asing untuk mengambil keuntungan. Dari mulai produk, ekonomi, politik hingga penipuan.

Itu satu contoh saja penipuan yang terjadi di masyarakat, ini belum sampai terjadi transaksinya. Banyak sekali yang sudah terjadi transaksi penipuan itu lantaran penipu mengetahui persis data-data pribadi korban dan keluarganya. Siapa namanya, pekerjannya, alamatnya dan seterusnya.
Lantas dari mana pelaku-pelaku kejahatan itu mendapatkan data pribadi korbannya?
Tidak ada yang bisa menjawab pasti, namun ada bebrapa kemungkinan dan pertanyaan. Apakah dari provider telepon, apakah dari warung penjual pulsa? STNK?, SIM?, facebook?, twitter?, BBM? ataukah dari e KTP?
Undang-undang tentang perlindungan data pribadi sudah diberlakukan di berbagai negara, di Asia antara lain Hongkong, Korea Selatan, Malaysia, Singapura, Thailand, dan Philipina. Bagaimana dengan Indonesia?
