Era digital dan teknologi Informasi saat ini sudah dialami oleh masyarakat di jaman ini.



Bahkan, untuk sekedar membicarakan hal yang sangat penting dalam kehidupan sebuah keluargapun dan menyangkut “kelangsungan atau berhentinya” sebuah pernikahan, dengan mudahnya dilakukan dengan teknologi komunikasi itu.

Hingga beberapa wanitapun mengeluh hal yang sama; mereka di talak suaminya lewat SMS, Email atau WA, dan gejala ini disinyalir semakin meningkat saja. Apakah hal ini dibenarkan dalam Islam, dan apakah talak para suami ini benar-benar telah ‘jatuh?’ dengan cara demikian?

Yang baik, Allah SWT menegaskan dalam Al Qur’an jika hubungan pernikahan itu merupakan hubungan yang suci dan sama sekali tidak diperbolehkan untuk ajang permainan, bahkan terkesan menyepelekannya. Bukankah ikatan pernikahan merupakan salah satu ibadah yang disahkan atas nama Allah. Seperti firman Allah berikut ini:

“Bagaimana kamu akan mengambilnya kembali, padahal sebagian kamu telah bergaul (bercampur) dengan yang lain sebagai suami-istri. Dan mereka (istri-istrimu) telah mengambil dari kamu perjanjian yang kuat.” (QS an-Nisa [4]: 21).

Meski dalam Islam Talak itu diperbolehkan, bahkan perkara halal meski dibenci Allah namun sebaiknya merupakan solusi darurat dan penanganannya ( lesan maupun tulisan) harus dengan cara baik, tertata dan ada adab tersendiri, bukan sebatas dengan media social, atau kecanggihan komunikasi. Bagimana mungkin hal yang sepenting itu hanya cukup diucapkan di SMS atau WA:

“Maaf terpaksa sekali saya talak kamu hari ini..”, jika ada waktu dan tempat yang baik dilakukan dari hati ke hati secara langsung dengan bertatap muka?

Sebaiknya hati-hati para suami saat menalak istrinya, karena hal demikian bisa jadi dalam Islam dianggap sebagai mempermainkan hukum Islam, meski dalam alasan praktis. Seperi Firman Allah:

“Apabila kamu menalak istri-istrimu lalu mereka mendekati akhir idahnya maka rujukilah mereka dengan cara yang baik atau ceraikanlah mereka dengan cara yang baik (pula). Janganlah kamu rujuki mereka untuk memberi kemudharatan karena dengan demikian kamu menganiaya mereka. Barang siapa berbuat demikian, sungguh ia telah berbuat zalim terhadap dirinya sendiri. Janganlah kamu jadikan hukum-hukum Allah permainan dan ingatlah nikmat Allah kepadamu, serta apa yang telah diturunkan Allah kepadamu, yaitu al-Kitab dan al-Hikmah (sunah). Allah memberi pengajaran kepadamu dengan apa yang diturunkan-Nya itu. Dan bertakwalah kepada Allah serta ketahuilah bahwasanya Allah Maha Mengetahui segala sesuatu.” (QS al-Baqarah [2]: 231).

Para ulama kontemporer menjelaskan jika hukum talak melalui media internet atau SMS hukumnya sama dengan hukum talak lewat tulisan. Meski ada perbedaan tentangnya, satu pihak menyatakan jika talak lewat tulisan itu apakah termasuk talak Sharih (tegas) yang tak perlukan niat (hal ini diungkap oleh al_Sya’bi, al- Nakha’i al-Zuhri, al-Hakam dan sebagian mazhab Hambali) atau sekedar kinayah (sindiran) yang perlukan niat hingga talaknya sah hal ini diungkapkan oleh Jumhur ulama yakni kalangan Mazhab Hanafi, Maliki dan Syafi’i .

Dalam kitab al-Mughni dijelaskan jika suami menulis kalimat talak dan diniatkan sebagai talak maka sudah jatuh talaknya, hal ini diyakini oleh ibnu Qudamah, ulama dari Mazhab Hambali.

Karena tulisan terdiri dari huruf-huruf yang mudah dipahami maknanya. Jika demikian dilakukan oleh seorang suami ketika ia menuliskan kata-kata talak pada istrinya dan ia berniat mentalak, maka jatuhlah talak sebagaimana ucapan.

Sedang Ulama Syafi’i menyebutkan talak itu tidak jatuh meskipun sudah diniatkan, karena mengapa suami menuliskan talak itu padahal mampu berbicara? Hingga hal itu bisa dikatakan bukan talak namanya, sama seperti halnya talak dengan gunakan isyarat.

Mengapa dengan tulisan itu menjadi polemik atau perbedaan pendapat? Karena tulisan itu punya beberapa kemungkinan, apakah saat menulis suami hanya main-main, menggertak, menyindir atau sungguh-sungguh. Atau apakah saat menulis di SMS atau jaringan internet ia dalam tekanan orang lain?

Belum lagi telepon selulernya mungkin sedang dipinjam orang hingga untuk main-main, atau hilang hingga dipergunakan oleh orang yang tak bertanggungjawab, begitu juga dengan jaringan internet, apakah dikendalikan oleh orang lain, bukan suaminya?

Az Zuhri berkata, “Jika seseorang menuliskan pada istrinya kata-kata talak, maka jatuhlah talak. Jika suami mengingkari, maka ia harus dimintai sumpah”.

Maka perlu kroscek secara seksama jika kedapatan talak dengan model SMS, Email, WA dan lain sebagainya. Niat dan kebenaran tulisan yang tertera disana apakah benar sebagai talak.

Dan jika itu memang benar, maka sah-lah talaknya dan si Istri beridah semenjak suami menulis dan mengirimkan tulisan tersebut.

Namun perlu diketahui, menurut ketentuan talak di Pengadilan Agama di Indonesia, jika talak memang tidak boleh main-main, hanya diucapkan suami dihadapan istri tanpa saksi hakim agama, maka menurut undang-undang, talaknya belum sah, hal ini untuk melindungi berapa pihak yang merasa terdzolimi.

Maka talak baru sah setelah suami mengucapkan ikrar talak dihadapan hakim agama, dan bisa disaksikan terbuka oleh umum.
