Kasus pernikahan hasil merusak rumah tangga orang lain bukan hal baru. Praktik ini, meski dianggap tabu, banyak terjadi di masyarakat.

Padahal, pernikahan terjadi karena ridho Allah SWT. Karena pada hakikatnya, pertemuan dua insan manusia bisa terjadi karena Allah SWT.

Jika pernikahan hasil merusak rumah tangga orang lain terjadi, bagaimana status hukumnya dalam Islam?

Dikutip dari laman konsultasi syariah, perbuatan merusak rumah tangga orang dikenal dalam fikih dengan istilah takhbib. Hal ini sangat dilarang oleh Rasulullah Muhammad SAW.

Larangan itu tertuang secara tersirat dalam dua hadis yang diriwayatkan dari Abu Hurairah RA. Hadis pertama diriwayatkan oleh Abu Daud, dishahihkan oleh Al Albani.

"Bukan bagian dariku seseorang yang melakukan takhbib terhadap seorang wanita, sehingga dia (wanita) melawan suaminya."

Hadis kedua diriwayatkan Ahmad, dishahihkan Syuaib Al Arnauth.

"Siapa yang merusak hubungan seorang wanita dengan suaminya maka dia bukan bagian dariku."

Sementara terkait hukum pernikahan takhbib, penjelasannya ada dalam kitab Al Mausu'ah Al Fiqhiyah.

"Sebagian ulama menegaskan dengan memberikan putusan paling susah untuknya dan melarangnya. Sampai Malikiyah mengatakan, bahwa wanita yang berpisah ini diharamkan untuk menikah dengan lelaki yang menjadi penyebab kerusakan rumah tangganya, diharamkan untuk selamanya. Sebagai hukuman baginya, dengan kebalikan dari apa yang dia inginkan. Agar semacam ini tidak menjadi celah bagi masyarakat untuk merusak hubungan para wanita (dengan suaminya)."

"Mereka – ulama Malikiyah – menyebutkan bahwa nikahnya dibatalkan, baik sebelum berhubungan maupun sesudah berhubungan, tanpa ada perbedaan pendapat di kalangan mereka. Namun yang menjadi perbedaan adalah apakah lelaki pelaku takhbib itu diharamkan untuk menikahi wanita selamanya ataukah tidak sampai selamanya."

Jawab:

Bismillah was shalatu was salamu ‘ala Rasulillah, wa ba’du,

Apa yang bisa bayangkan, ketika suami pertama wanita adalah anda? Istri anda didekati lelaki lain, hingga diapun jatuh cinta kepadanya dan berusaha meminta anda untuk menceraikannya, agar bisa menikah dengan lelaki itu. Tentu anda akan sakit hati dan marah kepada lelaki itu.

Saat ini, lelaki itu adalah anda. Dan pasti mantan suami dari wanita yang kini menjadi istri anda sangat benci kepada anda. Inilah dosa takhbib. Menjadi penyebab percerian dan kerusakan rumah tangga. Karena kehadirannya, membuat seorang wanita menjadi benci suaminya dan meminta untuk berpisah sehingga bisa menikahi lelaki kedua yang sedang dekat dengannya.

Sebagaimana anda

Dalam banyak hadisnya, Rasulullah shallallahu ‘alaihi wa sallam memberikan ancaman keras untuk pelaku takhbib. Diantaranya,

Dari Abu Hurairah radhiyallahu ‘anhu, Rasulullah shallallahu ‘alaihi wa sallam bersabda,
لَيْسَ مِنَّا مَنْ خَبَّبَ امرَأَةً عَلَى زَوجِهَا

“Bukan bagian dariku seseorang yang melakukan takhbib terhadap seorang wanita, sehingga dia melawan suaminya.” (HR. Abu Daud 2175 dan dishahihkan al-Albani)

Juga dari Abu Hurairah radhiyallahu ‘anhu, Rasulullah shallallahu ‘alaihi wa sallam bersabda,
وَمَنْ أَفْسَدَ امْرَأَةً عَلَى زَوْجِهَا فَلَيْسَ مِنَّا

“Siapa yang merusak hubungan seorang wanita dengan suaminya maka dia bukan bagian dariku.” (HR. Ahmad 9157 dan dishahihkan Syuaib al-Arnauth).

Hukum Pernikahan Hasil Takhbib

Kita fokus di hukum pernikahan hasil merusak rumah tangga orang lain.

Terdapat kaidah fiqh yang menyatakan,

من تعجل شيئا قبل أوانه عوقب بحرمانه

Siapa yang terburu-buru mendapatkan sesuatu sebelum waktunya, dia dihukum dengan cara dilarang untuk mendapatkannya.

Terburu-buru mendapatkan sesuatu sebelum waktunya, termasuk pelanggaran dalam agama. Seorang baru bisa mendapatkan warisan dari orang tuanya, jika ortunya telah meninggal. Tapi jika dia buru-buru ingin mendapatkannya dengan cara membunuh ortunya, maka tindakannya menjadi penghalang baginya untuk mendapatkan warisan dari ortunya.

Dan semua pernikahan yang diawali dengan cara yang batil, hasilnya juga kebatilan.

Atas dasar ini, sebagian ulama memutuskan bahwa ketika terjadi perpisahan dalam keluarga, sehingga si istri bersemangat untuk minta cerai disebabkan kehadiran lelaki baru, maka mereka dipisahkan selamanya. Dihukum dengan keputusan yang berkebalikan dengan harapan dan keinginannya.

Dalam Ensiklopedi Fiqh dinyatakan,

وقد صرّح الفقهاء بالتّضييق عليه وزجره ، حتّى قال المالكيّة بتأبيد تحريم المرأة المخبّبة على من أفسدها على زوجها معاملةً له بنقيض قصده، ولئلاّ يتّخذ النّاس ذلك ذريعةً إلى إفساد الزّوجات

Sebagian ulama menegaskan dengan memberikan putusan paling susah untuknya dan melarangnya. Sampai Malikiyah mengatakan, bahwa wanita yang berpisah ini diharamkan untuk menikah dengan lelaki yang menjadi penyebab kerusakan rumah tangganya, diharamkan untuk selamanya. Sebagai hukuman baginya, dengan kebalikan dari apa yang dia inginkan. Agar semacam ini tidak menjadi celah bagi masyarakat untuk merusak hubungan para wanita (dengan suaminya). (al-Mausu’ah al-Fiqhiyah, 5/251).

Dalam pernyataan lain, juga di Ensiklopedi Fiqh,

قد ذكروا أن النكاح يفسخ قبل الدخول وبعده بلا خلاف عندهم، وإنما الخلاف عندهم في تأبيد تحريمها على ذلك المفسد أو عدم تأبيده

Mereka – ulama Malikiyah – menyebutkan bahwa nikahnya dibatalkan, baik sebelum berhubungan maupun sesudah berhubungan, tanpa ada perbedaan pendapat di kalangan mereka. Namun yang menjadi perbedaan adalah apakah lelaki pelaku takhbib itu diharamkan untuk menikahi wanita selamanya ataukah tidak sampai selamanya.

فذكروا فيه قولين:

أحدهما وهو المشهور: أنه لا يتأبد، فإذا عادت لزوجها الأول وطلقها، أو مات عنها جاز لذلك المفسد نكاحها.

الثاني: أن التحريم يتأبد، وقد ذكر هذا القول يوسف بن عمر كما جاء في شرح الزرقاني، وأفتى به غير واحد من المتأخرين في فاس

Mereka menyebutkan adanya dua pendapat:

Pertama, dan ini yang lebih terkenal, bahwa mereka dipisahkan tapi tidak selamanya. Jika si wanita kembali kepada suami pertama, kemudian diceraikan oleh suami pertama atau suami pertama meninggal, maka si lelaki kedua ini boleh menikahi wanita itu.

Kedua, mereka diharamkan menikah selamanya. Diantara yang menyatakan pendapat ini adalah Yusuf bin Umar, seperti yang disebutkan dalam Syarh az-Zarqani, dan ini yang difatwakan beberapa ulama kontempporer di daerah Fez – Maroko. (al-Mausu’ah al-Fiqhiyah, 11/20).

Dalam kitab al-Iqna’ dinyatakan,

وقال في رجل خبب امرأة على زوجها : يعاقب عقوبة بليغة ، ونكاحه باطل في أحد قولي العلماء في مذهب مالك وأحمد وغيرهما ، ويجب التفريق بينهما

Syaikhul Islam mengatakan tentang orang yang mempengaruhi wanita sehingga bercerai dengan suaminya, lelaki ini harus mendapatkan hukuman berat. Nikahnya batal, menurut salah satu pendapat ulama dalam madzhab Malik dan Ahmad serta yang lainnya. Dan wajib dipisahkan keduannya. (al-Iqna’, 3/182).

Memang lelaki ini menikah dengan si wanita atas dasar saling ridha. Tapi perlu dia ingat, dia membangun keluarga dengan cara bermaksiat kepada Allah dan merusak keluarga orang lain…
