Direktur Eksekutif Institute for Criminal Justice Reform (ICJR) Supriyadi Widodo Eddyono mengatakan, pada 2017, ada 2 kasus kejahatan seksual pada anak yang pelakunya dituntut hukuman mati.
Dua tuntutan yang dimaksud yaitu kasus persetubuhan anak yang ditangani Pengadilan Negeri Sangatta, Kalimantan Timur, dan putusan oleh Pengadilan Negeri Sorong, Papua Barat.
"Pengguna hukuman mati dalam Perppu Kebiri sudah mulai dipraktikan dan mulai menjadi tren digunakan penuntut umum dalam dakwaan dan tuntutan," ujar Direktur ICJR, Supriyadi W. Eddyono dalam sebuah diskusi, Minggu 8 Oktober 2017.
Supriyadi mengatakan, PN Sangatta merupakan pengadilan pertama yang menerapkan pemberatan hukuman kejahatan seksual terhadap anak.
"Dakwaan pelaku Jurjani alias Ijur dilakukan pada Agustus 2016 dan telah menggunakan pasal dalam Perppu Kebiri," kata Supriyadi.
Hukuman Mati Meningkat
Berdasarkan monitoring dari Institute for Criminal Justice Reform (ICJR) terdapat tren meningkatnya jumlah penuntutan hukuman pidana mati di bawah pemerintahan Presiden Joko Widodo.
Sepanjang Januari 2016 sampai Juni 2016 ada 26 perkara tuntutan pidana mati dan 17 putusan pidana mati. Jumlah tersebut meningkat pada Juli 2016 sampai September 2017 menjadi 45 perkara tuntutan pidana mati dan 33 putusan pidana mati.
"Dibanding dengan tahun 2016, tren tuntutan dan vonis hukuman mati 2017 berdasarkan jumlah perkara menunjukkan kenaikan yang signifikan hampir dua kali lipat dalam penggunaan pidana mati," ungkap Supriyadi.
Supriyadi menambahkan, pada 2017 ini tren tuntutan pidana mati tersebut masih didominasi oleh kasus narkotika, selanjutnya kasus pembunuhan menempati urutan kedua, dan kejahatan seksual anal.
Menurutnya, peningkatan jumlah tuntutan hukuman mati mulai mengkhawatirkan karena proses eksekusi mati yang dilakukan Kejaksaan Agung dianggap melanggar prinsip keadilan dan hak asasi manusia.
Seperti yang dialami terpidana mati kasus narkotik Humprey Ejike Jefferson yang dieksekusi mati pada Juli 2016. Supriyadi mengungkapkan, saat itu padahal Humprey sedang mengajukan grasi kepada Presiden Jokowi.
Dalam Undang-undang Grasi, ujar Supriyadi, pelaksanaan hukuman mati yang sudah berkuatan hukum tetap harus ditangguhkan jika terpidana mengajukan grasi kepada presiden, sampai Keppres tentang penolakan permohonan grasi diterima terpidana.
Ia dan pihaknya mendesak agar Presiden Joko Widodo segera melakukan moratorium eksekusi hukuman mati di Indonesia. Terlebih lagi berdasarkan Universal Periodic Review (UPR) dalam sidang Perserikatan Bangsa-bangsa (PBB), Indonesia menerima rekomendasi dari sejumlah negara untuk memberlakukan moratorium hingga penghapusan hukuman mati.
Selama proses moratorium, Supriyadi dan pihaknya menyarankan kepada Presiden Joko Widodo untuk mengevaluasi kinerja jaksa agung sebagai pihak yang berwenang melakukan eksekusi mati.
"Dalam kondisi ketidakpastian dan keraguan terkait eksekusi mati, maka pemerintah segera melakukan moratorium eksekusi mati untuk menghindari semakin besarnya potensi pelanggaran hak asasi manusia," kata Supriyadi
Sementara itu di dalam kesempatan yang sama, Staf Ahli Deputi V Bidang Politik, Hukum, dan HAM Kantor Staf Presiden (KSP), Ifdhal Kasim, juga mengatakan bahwa tren pelaksanaan hukuman mati memang meningkat di bawah pemerintahan Presiden Joko Widodo atau Jokowi. Hanya saja ia tidak merinci jumlah tuntutan dan eksekusi hukuman mati yang terdapat pemerintahan sebelum Jokowi.
"Tiga tahun pemerintahan Jokowi-JK kita menyaksikan eksekusi yang sangat tinggi dibandingkan pemerintahan Presiden SBY (Susilo Bambang Yudhoyono)," katanya.
Ifdhal mengatakan, kebijakan hukuman mati akan tetap dipertahankan oleh pemerintah sebagai jalan yang paling baik untuk mengatasi munculnya atau tingginya penyalahgunaan narkoba di Indonesia.
Ia berpendapat, untuk mengubah pola pikir bangsa Indonesia terhadap penerapan penegakan hukuman dengan mendasarkan pada dasar negara Pancasila, masih dirasa sulit.
"Mengubah cara berpikir untuk mengganti sesuai dengan dasar negara Pancasila, ini kelihatan memerlukan waktu yang panjang, kita masih sangat pragmatis," ujar Ketua Komnas HAM 2007-2012 tersebut.
