Hakim Pengadilan Negeri (PN) Balige membacakan putusan terhadap nenek lanjut usia, Saulina boru Sitorus (92) atau Ompu Linda oleh Hakim Hakim Ketua, Marshal Tarigan di PN Balige, Tobasa, Senin (29/1/2018), dikutip TribunSolo.com dari Tribunnews.
Oppu Linda dituntut hukuman satu bulan 14 hari.
"Menurut kami, terdakwa harus menjalani hukuman satu bulan empat belas hari," ujar Marsahal lalu mengetuk palu sidang.
Ompu Linda terjerat kasus pengrusakan setelah dituduh menebang pohon durian milik Japaya Sitorus berdiameter lima inci di Dusun Panamean, Desa Sampuara Kecamatan Uluan Toba Samosir.
Ompu Linda berniat membangun makam leluhurnya.
Saat menjalani persidangan, Ompu Linda beberapa kali menyeka air matanya dengan sapu tangan berwarna putih.
Nenek yang sehari-hari bertentenun bertenun ini lemas mendengarkan putusan hakim.
Menyikapi putusan Hakim, Kuasa Hukum Ompu Linda Boy Raja Marpaung menngatakan kecewa.
Alasannya, karena hakim tidak mengindahkan pembelaan atau pledoi yang mereka sampaikan pada persidangan sebelumnya.
Kemudian, hakim dinilai terlalu "primitif" dalam menyatakan bahwa Japaya adalah pemilik tanaman.
Apalagi, hanya dengan keterangan saksi hanya didengar dari anak dan istri Japaya sendiri.
"Sementara banyak saksi yang menyatakan dalam persidangan yang rumahnya berkedakatan dengan lokasi tidak pernah melihat Japaya menanam dan memanen hasil tanaman yang menjadi barang bukti tersebut," ujarnya.
Kasus ini menyedot perhatian masyarakat luas karena harus menyeret perempuan uzur itu ke ranah hukum.
Enam anak Saulina juga terseret kasus ini dan Selasa (23/1/2018) telah divonis majelis hakim Pengadilan Negeri (PN) Balige dengan hukuman penjara 4 bulan 10 hari dipotong masa tahanan.
Keenam tervonis itu adalah Marbun Naiborhu (46), Bilson Naiborhu (60), Hotler Naiborhu (52), Luster Naiborhu (62), Maston Naiborhu (47) dan Jisman Naiborhu (45), masih harus menjalani sisa masa tahanan beberapa hari lagi.
Saulina boru Sitorus yang jika jalan harus menggunakan tongkat ini selalu menekankan jika dia dan anak-anaknya pernah minta maaf kepada penggugat yang masih terbilang saudaranya, Japaya Sitorus (70).
Upaya damai tidak tercapai karena menurut pihak tergugat tidak sanggup menuruti nominal yang diminta Japaya.
Dan mereka sudah dilaporkan ke polisi.
Menurut mereka, Japaya Sitorus meminta uang ratusan juta sebagai syarat berdamai karena kesal dan juga menghitung segala kerugian yang diakibatkan penebangan pohon tersebut.
Saulina mengaku, dirinya sudah mendapatkan izin dari empunya tanah wakaf tersebut.
Dan kini dia hanya menginginkan anak-anaknya pulang dan kembali melanjutkan hidup bersama keluarganya masing-masing.
